OVERVIEW: The Starbird LA Sweepstakes (the “Sweepstakes”) offers a fun way to win a trip for you and a friend to attend Starbird’s grand opening party in Los Angeles, California on 10/12/2023 (subject to change). The Grand Prize award will occur only if a total of at least 1 million views are achieved for Starbird’s Sweepstakes post on TikTok (the “Post”) during the Sweepstakes Period (defined below), so be sure to tell your friends and encourage them to view the Post as well. ELIGIBILITY: Only legal residents of the 50 United States plus D.C., 18 years of age or older, may enter. Not open to employees, officers, or directors -- or to members of the immediate family or household of any of the foregoing -- of Chicken Coup, LLC d/b/a Starbird Chicken, 75 Oak Grove Street, San Francisco, CA 94107 (“Sponsor”), or any of its parents, subsidiaries, affiliates, franchisees, or any advertising or promotion agencies involved in this Sweepstakes promotion (collectively, the “Sweepstakes Entities”). By participating in the Sweepstakes, you unconditionally accept and agree to comply with and abide by these Official Rules and all decisions of the judges, which shall be final and binding in all respects.
SWEEPSTAKES PERIOD: The Starbird LA Sweepstakes (the “Sweepstakes”) begins on 9/19/2023 at 10:30:00 a.m. Pacific Time (“PT”), and ends on 10/2/2023 at 11:59:59 p.m. PT (the “Sweepstakes Period”). All entries must be received by the end of the Sweepstakes Period. The Sponsor’s database computer is the official time-keeping device for this Sweepstakes.
HOW TO ENTER: To enter, look for Sponsor’s Sweepstakes Post on TikTok, add a comment to the Post, and tag a friend you would like to accompany you on the Grand Prize trip if you are selected as the Grand Prize winner. Using TikTok is free. TikTok is not a sponsor of or associated in any way with this Sweepstakes. Unlimited entries per person and per Tik Tok account per day, measured by PT. Any attempt by a person to enter more than the allowed number of entries by use of multiple names, Tik Tok accounts or any other method, may result in disqualification.
COMMENT REQUIREMENTS: Comments posted as entries must not contain any content that is obscene, pornographic, threatening, insulting, derogatory to any persons or groups, contain names or trademarks of other brands, or otherwise be offensive or inappropriate to Sponsor’s image as determined by Sponsor in its discretion.
WINNER SELECTION AND NOTIFICATION: One (1) potential winner will be selected, on or about 10/03/2023, from among all eligible entries. The potential winner will be notified by direct message in TikTok. No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If a potential winner does not respond within 2 days after the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected, time permitting. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.
PRIZES/ODDS: One (1) prize is available, which will vary based on the number of views achieved for the Post during the Sweepstakes Period. If 1 million or more views are achieved, the Grand Prize will be a trip for the winner and the person tagged in their winning entry to attend the Starbird grand opening event in Los Angeles, California on 10/12/2023 (subject to change). If fewer than 1 million views, then the Alternate Prize will be a $200 Starbird gift card.
The Grand Prize, if any, comprises the following elements: round trip airline transportation (coach class) for winner and one (1) guest between Los Angeles and major U.S. airport nearest winner’s residence; hotel accommodations (consisting of one (1) double occupancy, standard room) for two (2) nights; attendance at the Starbird LA grand opening event scheduled for 10/12/2023 (subject to change); plus a visa card for $500. If winner cannot attend on the dates specified, prize will be forfeited and may be awarded to an alternate winner, time permitting. Approximate Retail Value of Grand Prize: $3,500; actual value may vary depending on departure; If winner lives within 200 miles of Los Angeles, ground transportation may be provided in lieu of air travel; any difference between actual value and advertised value will not be awarded. Winner is solely responsible for the payment of all federal, state and local taxes and all additional meals, beverages, transportation or other expenses or costs relating to the prize not expressly set forth above. Major credit card will be required at hotel check-in to cover any incidental expenses. Winner and travel companion must have all necessary photo ID for air travel, and must travel on the same itinerary. Winner’s travel companion (the person tagged in the Grand-Prize winning entry/comment) will be required to sign a Liability/Publicity Release (where legal) prior to ticketing. Any winner or other person taking part in the trip who is a minor under the laws of his/her state of residence must be accompanied by parent or legal guardian who also must execute all documents on behalf of the minor. Prize is non-transferable and no substitution by winners or cash equivalent is allowed. Sponsor reserves the right to substitute prize for one of equal or greater value if the advertised prize becomes unavailable. All dates are subject to change. No responsibility is assumed for cancellation of any events beyond Sponsor’s control; if grand opening event is cancelled after travel has been booked, the remainder of the trip will be awarded as the complete Grand Prize.
Sponsor may conduct a background check to confirm any potential Grand Prize winner’s eligibility and compliance with these Official Rules. By entering, you agree to cooperate reasonably with any such background check, including for any proposed guest in the Grand Prize trip. Failure to cooperate may result in disqualification and selection of an alternate winner. If the background check reveals that a potential winner and/or their proposed guest has engaged in conduct that could damage the reputation or business of Sponsor, as determined by Sponsor in its discretion, the potential winner may be disqualified and the prize may be awarded to an alternate winner, time permitting.
No cash alternative or prize substitutions will be allowed, except in Sponsor’s discretion. A substitute of comparable or greater value may be awarded if any prize listed becomes unavailable for any reason. Allow 4-6 weeks after validation for delivery or arrangement for delivery of prize. Limit one (1) prize per household. Odds of winning depend on the number of eligible entries received.
GENERAL PROVISIONS: Acceptance of a prize constitutes winner’s permission for Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation except where prohibited by law. You agree that the Sweepstakes Entities and TikTok shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from acceptance, receipt, possession and/or use or misuse of any prize.
By entering the Sweepstakes, you further agree that (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (c) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses. These rules and any disputes relating hereto are governed by the internal laws of the State of California without regard to principles of conflicts of laws, and by entering, you consent to the exclusive jurisdiction of the state and federal courts in San Francisco, California for resolution of any disputes relating to the Sweepstakes and waive any objection thereto.
No responsibility is assumed for any damage to your mobile device or computer occasioned by participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays. Without limiting the generality of the foregoing, no responsibility is assumed for incomplete, illegible, misdirected, misprinted, forged, tampered with, altered, late, lost, damaged, stolen, or postage-due submissions, prize notifications or other Sweepstakes materials, all of which are void; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.
Any individual who is found to be tampering with the entry process or the operation of the Sweepstakes or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, may be disqualified, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
In the event of a dispute as to the identity of the entrant, the entry will be deemed submitted by the natural person to whom the mobile phone number associated with the entry has been assigned by a telecommunications carrier or other organization responsible for assigning individual telephone numbers.
Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
